Summary of Florida’s Capital Post Conviction Review Process
(Step 1, the actual trial, appeared in the October issue and Step 2, the direct appeal, in the November issue) Michael Lambrix
Step 3, Petition for a Writ of Certiorari
Within 30 days after the decision (conviction and/or death sentence is upheld) is rendered by the Florida Supreme Court (FLSC), notice must be made of intent to pursue a petition for writ of certiorari (PWC) requesting that the USSC review a specific question of constitutional law relevant to the case. Review by the USSC is discretionary and limited exclusively to questions of conflict of constitutional law. Typically a PWC is summarily denied within 3 months of filing. If review is granted, the case is docketed on the next term of the court for full briefing and oral arguments.
Step 4, State Post Conviction Appeal (Rule 3.850 Motion)
After certiorari review is denied by the USSC, the case is remanded back to the original trial court. Within 30 days of the conviction being affirmed, collateral post conviction counsel must be assigned, per FL Rule of Criminal Procedure, 3.851. In FL this is accomplished by either having a staff lawyer with the state funded Capital Collateral Regional Counsel (CCRC) assigned or if a CCRS lawyer is not available then a registry lawyer (=a lawyer in private practice) is assigned to the case.
The original post conviction appeal must be filed with the original trial court within 1 year of completion of the previous direct appeal. Although this is commonly known as a Rule 3.850 motion which is the primary rule governing all post conviction proceedings in criminal cases in FL, Rule 3.851 is exclusively applicable to capital post conviction proceedings and explicitly defines the nature and content of claims that may be raised as well as provides a general timetable in which each stage of post conviction review must be accomplished by the trial court.
However, very rarely will an original post conviction appeal actually be filed within this one year time frame due to various delays, i.e. obtaining relevant public records. To protect against a procedural default for failure to initiate the original post conviction appeal within the statutorily defined time frame of one year, a lawyer must file a shell motion with the trial court together with a contemporaneous motion for extension of time, (a shell motion = a draft of claims to fully raised once the relevant public records are provided.)
The claims generally raised within a CPCA include primarily and all claims alleging ineffectiveness by the trial lawyer. Such claims of error or incompetence must be raised within this original post conviction appeal, or will be procedurally barred from review forever.

To identify such claims the appeal counsel must investigate the entire case: look at the evidence presented at trial, especially forensic (DNA), claims of innocence. A claim of innocence based upon evidence not presented at trial cannot be raised in the earlier, direct appeal.
Once the completed original post conviction appeal is presented to the original trial court, the state is provided a reasonable opportunity to provide an answer to all allegations raised. The trial court will then schedule an evidentiary hearing on any claims upon which a factual dispute exists (To be continued.) Legal Question
How can I obtain information about compensation for the wrongly convicted? Unfortunately, only 16 states have any system to compensate such individuals, and the level of compensation varies wildly; Florida has no mechanism to compensate the wrongfully convicted.

Busby v State of Florida 2004 WL 2471387 (11/4/2004) Relief granted
Background: Busby raised thirteen issues on appeal, FLSC ruled that the trial court erred in denying Busby's challenge for cause against potential juror Kim Lapan and declined to address the remaining issues. The FLSC agreed that Lapan should not have been left on the jury. The fact that he was former guard at FSP who was openly biased against DR inmates and who had admitted being willing to execute people who had committed premeditated murder on the jury, presented reasonable doubts as to his impartiality.
Everett v State of Florida 2004 Fla. LEXIS 2119 (11/24/2004) Relief Denied
FLSC denied all issues summarily but analyzed the first in light of Miranda and its progeny. Defendant contends that his motion to suppress his confession and the biological samples he provided should have been granted because they were obtained in violation of his rights under the 5th amendment. (The 5th provides that no person shall be compelled to be a witness against himself). Here the issue is whether an officer’s request for a consent to search or service of an arrest warrant on a defendant in custody who has invoked the right to counsel violates the 5th amendment. Held: the service of an arrest warrant is a routine police procedure, does not require an answer from a suspect, and does not constitute interrogation. Request for consent to provide DNA samples is not reasonably likely to elicit incriminating responses.

News from the inside

Looking back, this has been quite an amazing year. I know it has a great deal to do with God being with us, putting us in contact with all the right people at all the right times, the absence of Michael Moore and his evil intentions, replaced by men that seem to be working with reason and heart.
It was so very encouraging to check the list of goals we had this same time last year, starting with our first meeting with Governor Bush, Secretary Crosby and Region Director Carter. The outcome from that meeting should still for some of you be memorable as we hope the sweatshirts, thermals and socks are keeping you warm this winter as well.?
We had three major things on the agenda back then, the blasting heat you endure every summer, the hobby crafts that was so greatly missed, and pictures in the visiting park that we all so desperately wanted and needed… That meeting was the first of several, and since we are getting the pictures back in the park, all three major issues have been resolved over the year in a very satisfying way.
I know there has been some confusion about the pictures in the park, and I did contact Secretary Crosby and later spoke to Director Carter over the phone (today the 26th of Dec.) and he assured me it was only a matter of some mix up in timing with the paper work, and he promised that the pictures WILL be in the visiting park for death row as soon as possible.
We have had other things on the agenda, little things as permission to donate envelopes, permission to send in more than five pages in regard to the newsletter, helping some of you individually with various things, and more are still in the works.
While working with the DOC the goodwill from both ‘sides’ has been noticeable, and as long as we are being reasonable and do not interfere too much with daily routines and security we can come a long way. This year to me and the other moderators of FDRAG has been a proof that we can accomplish much more when we are not divided into “enemy camps” but more so try to work together across the “border”, a border that might not even have to be there to begin with.
Which of course brings me to our recent two meetings – the first one with the wardens of both institutions, and the second one a follow up with Region Director Carter. Things on the agenda was the library, how to replace fans for those of you who are indigent, the quality of the paintbrushes and adding to the hobby craft list.

We could not, due to various (reasonable) reasons, be allowed a separate death row library, but we were granted permission to donate books to the main library, which will give us much better chances of getting books in larger quantity and for much less money. You will of course be informed of which books will be donated. This will also be a great opportunity to donate your books to FDRAG who can then donate those books back to the main library for all of you to read.
We also discussed the possibility of getting crocheting and knitting needles back among available hobby craft items. I am afraid that is not going to happen- at least not in the near future, or without a miracle, (we have seen a few of those too during this past year?.) What is being looked into however is canvas and acrylics.
As for FSP… We had the pleasure of meeting the new warden and also talked about the antenna/cable situation. All seems to be okay so please contact us again for further planning.
In regard to envelopes... We agreed that the donated envelopes will be available on the wings and can be given to you per request. This will start in the New Year.
As far as your fans….if you are indigent and your fan breaks down? At this time there are enough fans in stock so that you can get one by requesting one at the institution.- no charge- Again, this is only if you are indigent. The rest of you will have to ship them out for repair under warranty or buy a new one. Eventually when there are no more fans in stock, you can just give us your name and DC number and we have permission to donate you (if indigent) a fan. Also, if you are not indigent but so short of money you cannot afford a fan, we will still try to help.
And…. I guess that is it for now….
It has been hard work but a total pleasure working with all involved over the year – the moderators and members of FDRAG – all of you – the DOC – and not only believing but also seeing that it does make a difference.
I know I speak for all of us at FDRAG when I thank you all for your encouragements – the cards, the stamps, the money, the support and for just giving us an opportunity to be a part of your lives…

FDRAG would like to acknowledge that Florida Support did intend to donate 722.28 dollars towards the fans. However, the money arrived after we officially announced that we had accomplished our goal. Further more Florida Support had previously been informed that their money would not be accepted, as the leader of Florida Support was accusing FDRAG of fraud. Therefore, FDRAG immediately sent the 722.28 dollars back to Florida Support, and since the money was received and kept, we hope those funds are used to further their work towards helping you men on Florida’s death row. For the benefit of those who saw the copy of the check printed in the first “Florida Support” newsletter, we are printing a copy of the money order we sent back to them. This is not a contest! We just feel you deserve the truth.
By doing this we hope and pray for a peaceful and conflict free Happy New Year.
