P. 3.851(b), COUNSEL SHALL BE APPOINTED TO HANDLE POSTCONVICTION PROCEEDINGS FOR APPELLANT & AS THE OFFICE OF THE CAPITAL COLLATERAL REGIONAL COUNSEL-NORTHERN REGION WAS ABOLISHED EFFECTIVE JULY 1, 2003, THE CHIEF JUDGE OF THE THIRD JUDICIAL CIRCUIT SHALL, WITHIN THIRTY (30) DAYS FROM THE DATE OF THIS ORDER, APPOINT REGISTRY COUNSEL TO HANDLE POSTCONVICTION PROCEEDINGS FOR APPELLANT.; THE CHIEF JUDGE OF THE CIRCUIT SHALL FORTHWITH ASSIGN CASE TO A JUDGE QUALIFIED TO HANDLE CAPITAL CASES & A COPY OF SAID ASSIGNMENT SHALL BE FURNISHED TO THIS COURT.

ORDER-COUNS APPOINTMENT (POST-CONVICTION)

 

 

Pursuant to Florida Rule of Criminal Procedure 3.851(b), counsel shall be appointed to handle postconviction proceedings for appellant. As the Office of the Capital Collateral Regional Counsel-Northern Region was abolished effective July 1, 2003, the Chief Judge of the Third Judicial Circuit shall, within thirty (30) days from the date of this order, appoint registry counsel to handle postconviction proceedings for appellant. In accordance with this Court's opinion issued in Amendments to Florida Rules of Criminal Procedure 3.851, 3.852, and 3.991 and Florida Rule of Judicial Administration 2.050, 802 So. 2d 298 (Fla. 2001), the chief judge shall forthwith assign this case to a judge qualified to handle capital cases. A copy of the assignment shall be furnished to this Court.

 

 

 

 

 

The doclet on Globe doesn't mention George Blow - but we know it's him from the Commission page. The Chief Circuit Judge of the Third Judicial Circuit is Julian E. Collins. Vernon Douglas is a Third Circuit Judge. Not very interesting so far..... but: Vernon Douglas who was trial judge for Blackwelder and was appointed to preside over the post conviction proceedings, was also trial judge for Globe -- it doesn't mention if he has been assigned to the post-conviction case for Globe as well.

 

Oh,  and Vernon Douglas was trial judge for Andrew Busby, as well  - Busby was Globe's co-defendant.

 

Second Circuit was assigned to the direct appeal in both Busby's and Blackwelder's cases. Busby's sentence (on direct appeal) was recently reversed by the FSC. He therefore didn't get to the post-conviction stage, which is a good thing, as it would probably have made Mr. Blow the busiest man in the state of Florida!

 

Anyway... point in this whole thing is you'd think that Judge Vernon Douglas might have noticed the similarity of the cases, and he would almost certainly be aware that Blackwelder was said to be innocent by another inmate the Columbia CI -- and he may even have heard of Globe's admission, as well. And while on the subject of Globe: He tried to claim sole responsibility for the murder which he and Busby were convicted of.
